1. Acceptance of Terms

By accessing or using NextPOS (“Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. If you register on behalf of an organization, you represent that you have authority to bind that organization.

2. SaaS Service Description

NextPOS provides cloud-based point-of-sale, inventory, accounting, CRM, payroll, and related ERP modules on a subscription basis. Features vary by plan. We may update functionality to improve security, performance, or compliance.

3. Subscription Billing

Subscriptions are billed in advance on monthly or yearly cycles in Pakistani Rupees (PKR) unless otherwise stated. Plans include Starter, Business, and Enterprise tiers with defined branch and user limits. Free trials, if offered, convert to paid subscriptions unless cancelled before the trial end date.

4. Payment Policy

Payments are processed through approved payment gateways including PayFast. You authorize us to charge your selected payment method for recurring fees, taxes, and applicable charges. Failed payments may result in past-due or suspended access until resolved.

5. Refund Policy

Subscription fees are generally non-refundable except where required by law or explicitly approved in writing. Partial-month refunds are not provided for mid-cycle cancellations. Contact support within 7 days of an erroneous charge for review.

6. User Responsibilities

You are responsible for accurate business data, user access controls, password security, and compliance with applicable tax and retail regulations. You must ensure authorized personnel use the Service appropriately.

7. Acceptable Use

You may not misuse the Service, attempt unauthorized access, interfere with infrastructure, upload malicious code, or use the platform for unlawful activities. We may suspend accounts that violate acceptable use policies.

8. Data Ownership

You retain ownership of your business data entered into NextPOS. You grant us a limited license to host, process, and back up data solely to provide and improve the Service.

9. Privacy

Our Privacy Policy describes how we collect and use personal and business information. By using the Service, you also agree to the Privacy Policy available at /privacy.

10. Account Termination

You may cancel your subscription at any time; access continues through the paid period unless otherwise specified. We may terminate or suspend accounts for non-payment, abuse, or legal requirements with reasonable notice where practicable.

11. Limitation of Liability

To the maximum extent permitted by law, NextPOS is not liable for indirect, incidental, special, or consequential damages, including lost profits or data loss. Our aggregate liability is limited to fees paid in the twelve months preceding the claim.

12. Intellectual Property

NextPOS software, branding, documentation, and platform design remain our intellectual property. No rights are granted except as necessary to use the Service under your subscription.

13. Service Availability

We strive for high availability but do not guarantee uninterrupted service. Maintenance, upgrades, or third-party outages may cause temporary downtime. Offline POS features may mitigate connectivity issues where supported.

14. Governing Law

These Terms are governed by the laws of Pakistan. Disputes shall be subject to the exclusive jurisdiction of competent courts in Pakistan unless mandatory consumer protections require otherwise.
